GENERAL INFORMATION Linda believes the mediation belongs to the participants and therefore, they determine the structure and timing of joint sessions. Linda is available for pre-mediation and post-mediation consultation and conference calls to help with any questions which may arise. MEDIATION BRIEFS Mediation briefs are recommended. Generally, the best practice is for counsel to prepare a brief to be exchanged with opposing counsel and a "confidential" brief to be provided to Linda. Please provide opposing counsel's brief and the "confidential" brief to the client to be discussed in advance of the mediation so that the client can be prepared as well as possible to discuss the concerns which are likely to arise at the mediation. Briefs are requested at least five business days before the mediation. Counsel can fax short briefs (no more than 5 pages) to Linda at 310-201-0016 or 818-907-1850. ATTENDANCE AT THE MEDIATION Linda recommends that counsel discuss their plans regarding who will and who will not be at the mediation. It is Linda's experience that mediations work best when more, rather than fewer, people attend, especially the decision-makers. | ||||
