What do you do? Linda helps people, businesses and organizations end disputes, avoiding the high cost and long delays of litigation. As an attorney and a trained and experienced dispute resolution professional and negotiator, she helps clients resolve disputes creatively and efficiently using mediation or arbitration as appropriate.

What is the difference between Mediation and Arbitration? Mediation assists parties in reaching a mutually agreed upon resolution to their dispute. A mediator identifies obstacles to settlement and develops strategies for overcoming them. Mediation is voluntary, confidential and non-binding.

Arbitration resolves the parties' disputes with a binding decision. A neutral arbitrator decides the matter after considering documents, statements and other evidence presented by each party.

What is your role as the Mediator? Each dispute is unique. Linda believes that the process of mediation belongs to the participants.

Generally a mediator is an impartial neutral intermediary whose role is to help the participants reach settlement through assisted negotiations. Linda sees her role in the mediation process as follows:
to actively listen to the needs and interests of all those involved in the dispute;
to provide a "reality check" and help everyone analyze the strengths and weaknesses of their respective positions;
to keep the lines of communication open;
to identify obstacles to resolution;
to suggest creative ways to get to "Yes";
and to help everyone strategically negotiate until they reach a resolution.

What happens at a mediation? There are a variety of ways that mediations can proceed; sometimes in joint sessions and other times in separate sessions with the mediator, called "caucuses".

The parties, their counsel and Linda jointly decide how best to proceed with their particular mediation.

Before a joint session, Linda works closely with counsel and the parties coaching them on how to talk about their feelings, interests and positions in a constructive manner in the joint session to ensure the joint sessions are productive.

What is your "style" of mediation? Linda is not locked into any one style, whether evaluative or facilitative. Every mediation stands on its own. Linda believes that her job is to be flexible and creative to meet the needs of the parties and their counsel. In all instances, Linda coaches counsel and their clients in strategic negotiation.

What are your fees? Linda charges $375.00 per hour or $3,750.00 per day. Any expenses incurred, such as travel or room rental, are charged at actual cost.

Through extensive training and experience, she is able to work with you and your client to ease concerns, assist you toward a resolution you can live with and make the experience as beneficial as possible.
